Enforcing the Hyde Amendment

This order reverses two orders issued by the Biden Administration in response to the U.S. Supreme Court’s 2022 Dobbs decision that returned authority over abortion regulation to the states. Those orders directed federal agencies to take steps to offset state-level abortion restrictions, which included expanding access to mail-order abortion drugs, opening pro-life pregnancy crisis centers to charges of deception and fraud, and pressuring health insurance and medical providers to circumvent or possibly even violate state laws. While many Americans believe passionately that abortion is a right that shouldn’t be subjected to legislative restrictions, the Supreme Court’s decided otherwise, making it a state legal matter. This means that cessation of federal agency efforts to undermine state abortion restrictions is a pro-federalism decision.
