Keeping Men Out of Women’s Sports
This order builds on goals and definitions established in a prior EO aimed at protecting women from biological males who compete in all-female sports leagues and use facilities reserved for women. It applies Title IX’s protections for women in sports by directing federal agencies to “rescind all funds from educational programs that deprive women and girls of fair athletic opportunities,” and “prioritize Title IX enforcement actions against educational institutions . . . that deny female students an equal opportunity to participate in sports and athletic events by requiring them, in the women's category, to compete with or against or to appear unclothed before males.” Since these measures return federal agencies to practices consistent with Congressional statutes, they advance federalism compared to the actions of the Biden administration, which pressured educational institutions to bend the law in pursuit of its ideological agenda.
The order also calls on federal officials to convene representatives from major sports organizations and bodies, along with women harmed by male participation in their sports, to develop rules that will protect women’s rights to equal participation in sports. To this end the order calls for a convening of state attorneys general to discuss best practices and share stories of women by biological men competing against them. The order also includes a number of directives that apply pressure to international sporting bodies, including the International Olympic Committee, to protect the rights and safety of female athletes.
